Court demands reasons for breaking contract with Lavra and adjourns meeting

The Economic Court of Kyiv demanded that the Kyiv-Pechersk Lavra National Reserve provide an act on the results of the inspection in the Monastery, because of which the Ministry of Culture decided to terminate the indefinite lease agreement for the Lower Lavra. Lavra's lawyer Nikita Chekman wrote about this in his Telegram channel.

The lawyer said that “representatives of the Monastery repeatedly tried to obtain the specified Act on their own, but in response they received a message that the requested information was classified as restricted access ‘for official use’ and therefore could not be provided.”

The consideration of the case on the invalidity of the termination of the lease agreement was postponed to May 19, 2023.

According to the Lavra's lawyer, this was done so that "the parties could familiarize themselves with a sufficiently significant document" and be able to "form their position on the subject and grounds of the claim."

At the same time, the lawyer believes that such a court decision indicates preparation for an objective and comprehensive process.

“The court urged the parties to adhere to the principle of good faith and provide all available evidence in the case. <...> We believe that the court has determined a reasonable period both for the participants in the trial to implement their cases and for the timely resolution of the dispute on the suit of the Monastery against the Reserve,” he stressed.

As reported by the UOJ, the court postponed the hearing on the claim of the Kyiv-Pechersk Lavra Reserve against the Monastery to May 1, 2023.
